When Cash Back on A Real Estate Closing Is Legal

I face this questions on at least a weekly basis from either a phone call or email.  Many people want to know just when they may receive funds from a closing that are not shown on the HUD or why they can not just "add" a line to the HUD, gain approval, and receive funds.  In most cases these are legitimate requests and the party is trying to fund something to allow for actual repairs to the home they are purchasing.  Ever increasing right now is the number of foreclosure/bank owned properties that contain frozen and burst pipes that may require significant repair. 

In many of the cases we can find a way to escrow or prepay repairs so that the items are addressed, but not cash directly to the buyer for this matter.  Occasionally on the bank owned homes we can not because the bank will not perform repairs for any reason.

South University in Ann Arbor Gaining Housing

Several local developers have proposed two new towers on South University in Ann Arbor for student housing and mixed retail space.  The development if approved may qualify for brownfield credit as well as solar and other green systems.  Housing for about 1,750 beds is expected as well as 380 parking spaces and 302 bicycle spaces.  Additional preliminary information is available here.

What Is the "SEV", Proposal A, & Why Do My Property Taxes Increase With Dropping Home Prices?

As the latest round of tax bills came out a few weeks ago I've received more communication from upset people about their taxes.  I'm sure to a large extent Proposal A and declining home values are the reason for it.  This article provides what I feel is a reasonably clear explanation of what to expect and why the tax situation in Michigan occurs the way it does.

Real Estate Still a Good Tax Benefit

With all of the discussion in the "downturn" in our economy and home prices this article still addresses a few of the tax advantages of home ownership.  I personally and professionally believe that home ownership is still a strong investment and with our strong rates for mortgages we should still see home sales for long term investments.

Great New Park from Ann Arbor Greenbelt & Watershed Council

The City of Ann Arbor just obtained 13.5 acres, as a new park, with what is described as a "glorious woodlands" and one of the the most pristine streams in the area.  Funds from the City's Greenbelt Tax were used for the purchase of the property. An article here addresses this great acquisition for the City Park Commission.

Can't Sell The Home? Carefully Consider Before You Rent.

As the market has resulted in additional homes on the market and slower sales I've seen a significant number of homeowners turning to rental to pay their mortgage and ensure that someone is paying their utilities and keeping the vacant home from being stripped for copper. 

Carefully evaluate the tax planning needs if you begin to rent your home, plus contact someone to assist you in compliance with a local lease that is valid, credit screening, and evaluating tenants.  I have over 9 years working in this area and can assist you for a relatively minimal fee if you choose.  Unfortunately, I've handled several cases lately where tenants were not properly screened and resulted in losses of over $8,000 before the owner was back in possession.  A good initial primer of the rental evaluation can be found in this article

Ypsilanti's New Walgreens. Convenience, Taxes, and Jobs!

Walgreens Pharmacy is building a new store in the City of Ypsilanti, on the corner of Prospect & Michigan Avenue.  The property was formerly owned by a local non-profit, SOS, and a private owner of a rental store.  The store is a welcome addition to the tax rolls of the City, since SOS as a non-profit paid no taxes, and as an addition of approximately 25 jobs when completed in Summer 2008.

This location also provides a more convenient location for the public in downtown and eastern Ypsilanti as the prior location at Washtenaw and Hewitt was quite a commute for some of my elderly clients with limited mobility.  I of course can not disagree since it will be more convenient for my as well. 

While the demolition has already occurred, this article addressing the store, prompted this post.

Michigan Legislators Helping Those Facing Mortgage Problems

There may be some help for those in Michigan facing foreclosure.  The Michigan House of Representatives are calling for an aggressive plan to work with those people at risk and facing adjustable rate mortgages, or other concerns for home loss.  Only time will tell how this develops in light of both the Federal issues and Michigan's tax/budget crunch right now.

Rising Concers of Stripping Vacant Foreclosures for Copper Pipes

Recent article here addressing a problem that my office has been seeing and experiencing with some of our clients and prospective clients.  With the price for scrap metals increasing we are seeing vacant homes, foreclosed homes or just vacant/unsold homes  being broken into and the walls cut open for the copper plumbing.  In addition, I have seen homes where the furnace and air conditioning compressors were cut off and removed as well.
